Conditions to Register Industrial Design in Bahrain

The Legislative Decree No. 6 of 2006 with Respect to Industrial Designs outlines a few conditions required to be met by an industrial design in order to get registered in Bahrain;

It must be novel.
The creator must file it independently.
It should have adequate application in craft and industry and it should provide a unique appearance to a product in craft and industry.
It should not have been revealed to people in other countries or in Bahrain by any medium before the creator filed for industrial design registration in Bahrain.

Steps to Register Industrial Design in Bahrain

The creator of an industrial design has to go through the following steps for industrial design registration in Bahrain;

File an Application

The foremost step to register an industrial design is to send an application to the Ministry of Industry & Commerce. One application can comprise as many as fifty designs or drawings. Bahraini nationals can file an application on their own and foreigners who don’t have Bahrain residency have to involve the IP registration office or any other legal firm providing IP services in Bahrain i.e. Jitendra Consultancy. Moreover, if the creator wants to rectify a mistake in the application or withdraw it, he/she can do it anytime before the issuance of a decision from the Ministry.

Examination of Application

A proper examination of the registration application and its various attachments will be done by the Ministry to make sure that the application meets the standards and requirements of the law.

Acceptance for Registration

After making sure that the application of the creator meets the standards and criteria, the Ministry has to issue its decision that the application has been accepted. This notification has to be sent to the creator within 60 days after the examination process is completed. If the registration application is rejected by the Ministry, the Ministry will notify the applicant to make necessary changes and submit the application again within thirty days from the date of notification.

Publication of Registration

If the examination of the registration application is successful, the Ministry will publish that the particular industrial design or drawing has been accepted and added to the “Industrial Designs Register”. The ministry will also send a Ministry of Industry and Commerce stamped certificate to the creator of the design.

The cost of application submission is 40 Bahraini Dinars (one time).
