يحدد المرسوم التشريعي رقم 6 لسنة 2006 بشأن التصاميم الصناعية بعض الشروط التي يجب أن تتوافر في التصميم الصناعي ليتم تسجيله في البحرين، وتشمل هذه الشروط:

  • يجب أن يكون التصميم جديدًا.
  • يجب أن يقوم المبتكر بتقديمه بشكل مستقل.
  • يجب أن يكون له تطبيق كافٍ في الحرف والصناعة وأن يمنح المنتج مظهرًا فريدًا في هذا المجال.
  • يجب ألا يكون قد تم الكشف عنه للجمهور في البحرين أو في بلدان أخرى بأي وسيلة قبل أن يقوم المبتكر بتقديم طلب التسجيل في البحرين.

التصاميم الصناعية التي لا يمكن تسجيلها في البحرين

  • يحدد القانون بعض التصاميم الصناعية أو الرسوم التي لا يمكن تسجيلها في البحرين، وهي كالتالي:

    • التصميم الصناعي الذي يتشابه مع علامة تجارية مشهورة أو علامة تجارية مسجلة بالفعل في البحرين.
    • التصاميم الصناعية التي تحتوي على أعلام أو أختام أو رموز دينية أو شعارات تابعة للبحرين أو لدول أخرى.
    • التصاميم الصناعية التي تتعارض مع الأخلاق العامة أو النظام العام.
    • التصاميم التي تم تشكيلها لتحقيق متطلبات تقنية أو تشغيلية بحتة. 

     

خطوات تسجيل التصميم الصناعي في البحرين

يتعين على المبتكر اتباع الخطوات التالية لتسجيل التصميم الصناعي في البحرين:

  • تقديم الطلب

The foremost step to register an industrial design is to send an application to the Ministry of Industry & Commerce. One application can comprise as many as fifty designs or drawings. Bahraini nationals can file an application on their own and foreigners who don’t have Bahrain residency have to involve the IP registration office or any other legal firm providing IP services in Bahrain i.e. Jitendra Intellectual Property Co WLL. Moreover, if the creator wants to rectify a mistake in the application or withdraw it, he/she can do it anytime before the issuance of a decision from the Ministry.

  • فحص الطلب 

ستقوم الوزارة بفحص الطلب وجميع المرفقات للتأكد من استيفائه لمعايير ومتطلبات القانون. 

  • قبول التسجيل

بعد التأكد من استيفاء الطلب للمعايير والشروط، يجب على الوزارة إصدار قرار بقبول الطلب خلال 60 يومًا من إتمام عملية الفحص. وفي حال رفض الطلب، ستقوم الوزارة بإبلاغ المتقدم لإجراء التعديلات اللازمة وإعادة تقديم الطلب في غضون 30 يومًا من تاريخ الإخطار.

  • نشر التسجيل

إذا تمت الموافقة على الطلب، ستقوم الوزارة بنشر الإعلان عن قبول التصميم الصناعي وإضافته إلى "سجل التصاميم الصناعية". كما ستقوم الوزارة بإصدار شهادة مختومة من وزارة الصناعة والتجارة للمبتكر.

  • اسم مقدم الطلب وتفاصيله.
  • صور للتصميم من جميع الزوايا.
  • إيصالات الدفع.
